These Terms & Conditions constitute a legally binding agreement between you and Tour Era Travel Pvt. Ltd. Please read them carefully.

1. ACCEPTANCE OF TERMS

By accessing our website, making a booking, or using any services provided by Tour Era ("we," "us," "our"), you agree to be bound by these Terms & Conditions. If you do not agree to all terms, you must not use our services.

1.1 Eligibility

You must be at least 18 years old to make a booking. Minors (under 18) must be accompanied by an adult who accepts these terms on their behalf.

1.2 Modifications

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

2. DEFINITIONS

In these Terms & Conditions, the following terms shall have the meanings specified:

"Booking"
The reservation of travel services through Tour Era, confirmed by payment of a deposit or full amount.
"Tour Package"
A pre-arranged combination of travel services including accommodation, transportation, and activities.
"Client/Traveler"
Any person who books or participates in our travel services.
"Force Majeure"
Events beyond our reasonable control including natural disasters, wars, strikes, pandemics, government actions, etc.
"Tour Leader/Guide"
The person appointed by Tour Era to lead or accompany the tour.

3. BOOKING & PAYMENTS

3.1 Booking Process

To make a booking, you must:

  1. Select your desired tour package
  2. Complete the booking form with accurate information
  3. Pay the required deposit or full amount
  4. Receive booking confirmation from us

3.2 Payment Terms

3.3 Payment Methods

We accept payments through:

  • Credit/Debit Cards (Visa, MasterCard)
  • Bank Transfer
  • Online Payment Gateways
  • Cash (at our offices only)
PAYMENT SECURITY

All online payments are processed through secure, encrypted payment gateways. We do not store your complete credit card information on our servers.

4. CANCELLATION POLICY

Cancellation requests must be made in writing to our official email address. The cancellation date will be the date we receive your written request.

4.1 Cancellation Charges

4.2 Special Circumstances

  • Force Majeure: Different cancellation terms may apply
  • Medical Cancellations: May be considered with proper documentation
  • Group Bookings: Special cancellation terms apply
IMPORTANT

We strongly recommend purchasing travel insurance that includes cancellation coverage. The deposit is always non-refundable.

5. TRAVEL DOCUMENTS

5.1 Client Responsibility

You are responsible for ensuring you have:

  • Valid passport with at least 6 months validity beyond return date
  • Required visas for all destinations
  • Vaccination certificates if required
  • Travel insurance documents
  • Flight tickets (unless included in package)

5.2 Our Assistance

While we can provide guidance, obtaining visas and travel documents is ultimately your responsibility. We are not liable for visa denials or delays.

PASSPORT & VISA REQUIREMENTS

Entry requirements vary by destination and nationality. It is your responsibility to check and comply with all entry requirements. Visa processing times vary – apply well in advance.

6. HEALTH & SAFETY

6.1 Health Requirements

You must:

  • Be in good physical and mental health for your chosen tour
  • Disclose any medical conditions or disabilities during booking
  • Carry necessary medications
  • Obtain medical clearance for adventure activities if required

6.2 Safety Guidelines

During the tour, you must:

  • Follow instructions from tour leaders and guides
  • Wear safety equipment when required
  • Stay with the group unless otherwise arranged
  • Respect local laws and customs
SAFETY FIRST

Adventure activities involve inherent risks. You participate at your own risk after acknowledging these risks during booking.

7. LIABILITY & INSURANCE

7.1 Our Liability

Tour Era acts as an agent for various service providers (hotels, airlines, etc.). Our liability is limited to:

  • Exercising reasonable care in selecting service providers
  • Providing services as described in the tour package
  • Complying with applicable laws and regulations

7.2 Limitations of Liability

We are not liable for:

  • Loss or damage to personal belongings
  • Personal injury or illness
  • Acts or omissions of third-party service providers
  • Force Majeure events
  • Changes to itineraries due to unforeseen circumstances

7.3 Insurance Requirements

Travel insurance is mandatory for all international tours. Your insurance must cover:

  • Medical expenses and emergency evacuation
  • Trip cancellation and interruption
  • Loss of personal belongings
  • Personal liability
INSURANCE PROOF

You must provide proof of insurance before departure. Without valid insurance, we reserve the right to cancel your booking without refund.

8. TRAVELER CONDUCT

8.1 Expected Behavior

You agree to:

  • Respect fellow travelers, staff, and local communities
  • Follow local laws and customs
  • Not engage in illegal activities
  • Not cause damage to property or environment
  • Not disrupt tour activities

8.2 Consequences of Misconduct

If you violate these conduct rules, we may:

  • Remove you from the tour at your own expense
  • Forfeit all payments
  • Report to authorities if necessary
  • Ban you from future tours

9. TOUR CHANGES

9.1 Our Right to Modify

We reserve the right to:

  • Change itineraries due to weather, safety, or operational reasons
  • Substitute accommodations of similar standard
  • Change transportation modes if necessary
  • Cancel tours due to insufficient bookings (with full refund)

9.2 Price Changes

Prices may change due to:

  • Currency fluctuations
  • Fuel surcharges
  • Government taxes and fees
  • Changes in service provider costs

We will notify you of any significant price changes before departure.

10. INTELLECTUAL PROPERTY

10.1 Our Content

All content on our website and marketing materials is protected by copyright and trademark laws. You may not:

  • Copy, distribute, or modify our content without permission
  • Use our logos or branding without authorization
  • Create derivative works from our materials

10.2 Your Content

By submitting photos, reviews, or other content to us, you grant us permission to use them for marketing purposes.

11. PRIVACY

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy.

By using our services, you consent to our collection, use, and disclosure of your personal information as described in our Privacy Policy.

12. GOVERNING LAW

These Terms & Conditions shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these terms will be brought exclusively in the courts of Kathmandu, Nepal.

13. DISPUTE RESOLUTION

13.1 Informal Resolution

We prefer to resolve disputes informally. Please contact us first with any concerns.

13.2 Formal Process

If informal resolution fails, disputes will be resolved through:

  1. Mediation with a neutral third party
  2. Arbitration in Kathmandu, Nepal
  3. Legal proceedings as a last resort

14. MODIFICATIONS

We reserve the right to modify these Terms & Conditions at any time. The current version will always be available on our website.

Your continued use of our services after changes constitutes acceptance of the modified terms.
